CDcare Terms & Conditions.
  1. Item(s) in the CDcare App are to be purchased on installment; however, a buyer who desires to buy outrightly may select the one-off payment. Buyer(s) may change a chosen instalment plan anytime before the delivery of the item(s) is being processed.

  2. All orders for purchase are subject to approval.

  3. The Installment Plan allows a buyer to pay for an order in equal consecutive installments of desired even numbers of weeks or months e.g. 4 weeks, 2 months, 6 months etc. Any duration for payment as chosen by a Buyer must run its course, and the Buyer cannot review the period once the item(s) has been processed for delivery. Buyers can request to change their installment plan before reaching the midpoint of the chosen installment plan, or before delivery is processed, as the case may be; for instance, a Buyer who indicates an interest to purchase an Item(s) for a duration of say 6 months will only be entitled to request for delivery of such Gadget(s) after 3 months from the date of commencing payment and provided that 50% of the purchase price has been paid as and when due in accordance with the chosen installment plan.

    1. ​A Buyer who pays up 50% of the purchase price before half of the chosen duration (midpoint) for payment runs its course shall ONLY be entitled to request delivery when half of his chosen duration for payment (midpoint) is reached while a Buyer who pays up 50% of the purchase price as and when due shall be entitled to request delivery 15 days after half of his chosen duration (midpoint) for payment is reached.

    2. Instalment plan may be changed only 10 days before a Buyer reaches half of the duration (midpoint) of chosen instalment plan provided always that if the review extends the payment period beyond what was earlier chosen the Buyer shall have to wait until half (midpoint) of the new chosen period is reached before requesting delivery, notwithstanding that the Buyer has paid half of the purchase price.

  4. A Buyer who desires to change his/her chosen installment duration/plan for payment shall reach out to CDcare via the means provided by CDcare for that purpose and proceed as follows:

    1. ​Go to the “History” tab on the CDCare app, click on order, click on more options and proceed to change to the installment plan.

    2. The Buyer shall wait for approval from CDcare indicating whether the proposed new duration is acceptable or not. Suppose the proposed duration for payment is acceptable to CDcare. In that case, the Buyer’s payment plan shall be reviewed accordingly, always provided that until the Buyer receives the approval of CDcare that the change in duration has been accepted and approved accordingly, the initially chosen duration for payment shall stand and shall continue to run its course as if the Buyer has made no request for a change of installment plan/ payment duration.

    3. Once the change of installment plan/ payment duration is approved by CDcare, the Buyer shall be liable to immediately pay the amount due on the approved plan, if any.

    4. CDcare solely reserves the right to approve or not approve a Buyer(s)’ application to change his/her initial chosen installment plan/ duration for payment.

    5. Buyer(s) are liable to pay for the delivery of Item(s) ordered before delivery of the ordered Item(s) will be processed.

  5. Instalment plans attract no processing fee, additional cost or hidden charges but processing fees chargeable by payment gateway service providers is applicable, as well as the calculated delivery fee for the ordered Item(s) all of which shall be paid by Buyer (s) before ordered Item(s) are processed for delivery.

    1. ​CDcare may from time to time test the validity of a Subscriber’s payment card by debiting the Subscriber’s account via the updated payment card to the tune of N1000 or more depending on the volume of purchase a subscriber intends to make, or the value of an ongoing instalment payment; and the test and debt may be done with or without notice to the Subscriber(s).

    2. The debited sum shall be kept in the Subscriber’s Money Box and may be used by the Subscriber(s) in paying a due instalment payment.

    3. A Subscriber who enters details of a payment card(s) that is otherwise valid at the point of entry but may expire before the end date of the chosen instalment duration shall not be entitled to delivery of the ordered Item(s) notwithstanding that all other conditions of purchase and delivery has been met by such Subscriber(s) and CDcare shall be entitled to postpone delivery of the Ordered Item(s) to such Subscriber(s) until the Subscriber(s) either upload another payment card having an expiry date exceeding the end date of the chosen instalment duration or pays in full the unpaid balance of the purchase price and delivery fee for the Ordered Item(s).

  6. To subscribe to an Installment Plan on the CDCare App, Buyer is required to:

    1. ​Register (if already registered then sign in) on the CDCare App

    2. Once logged in, all available items are listed in the marketplace.

    3. Browse through the listed Item(s) and select your desired Item(s).

    4. Follow the prompts to choose your installment plan and provide other required details, then proceed to start your installment.

    5. Please note the following

      1. Buyer(s) must add his/her payment card details to enable CDcare automate payment, failure to do so shall mean that Buyer is not entitled to delivery of his/her item until the total installment has been completed.

      2. Buyer(s) who fail to add payment card details or meet other delivery conditions shall not be entitled to delivery of ordered Item(s) until the total installment has been completed.

    6. Successful subscription to an instalment payment plan is subject to CDcare approval. A Buyer(s) on approved subscription for instalment payment plan hereby agrees as follows:

      1. ​Not to travel out of Nigeria during the pendency of an active instalment payment plan. Failure to comply with this paragraph means the Buyer shall not be entitled to delivery of ordered Item(s) until the total instalment has been fully completed.

      2. To PERSONALLY take delivery of the ordered Item(s) AT THE REGISTERED ADDRESS. Delivery SHALL NOT be made to any person other than the actual Buyer (s), and SHALL NOT be delivered to the actual Buyer (s) at any address other than the registered address on record with CDcare.

      3. The delivered Item(s) shall, at all time during the pendency of an active installment plan, be kept at the delivery address and shall be provided by the Buyer (s) to the CDcare team for inspection as and when required until the installment is fully completed.

      4. To complete all installment payments before giving out any Item(s) ordered from and delivered by CDcare as a gift. Take note that a defaulting Buyer(s) who is unable to promptly return the ordered Item(s) in line with Clause 10 paragraphs (i) to 10(iv) because he/she has given out the ordered Item(s) as a gift shall be liable to be charged for fraud and criminal conversion as indicated in Clause 10(ix).

  7. Failure to pay an instalment sum on or before the due date(s) entitles CDcare to terminate an active instalment plan and the money already paid refunded less an amount equal to 10% of the total instalment sum already paid including the initial deposit if any. No refund shall be made earlier than 30 days from the date of termination of the installment plan. Where no notice of termination is communicated to the Buyer (s), and the Buyer (s) continues making payment, CDcare shall have the right to defer/delay delivery of the ordered item(s) until the purchase price is fully paid up by the Buyer (s).

  8. Buyer(s) who fail to consistently pay the instalment sum as and when due shall not be entitled to delivery of ordered item(s) until the full purchase price is completely paid up. For the avoidance of doubt, a Buyer who fails to make payment consistently can only request for delivery after paying the last instalment sum, and CDcare reserves the right not to honour any request for delivery made by such Buyer (s) before paying the last instalment, and to delay the delivery of the ordered Item(s) until the last instalment has been paid by the Buyer (s).

  9. Buyer(s) may make payment any time before the due date; however, payments will be automatically attempted on the scheduled dates from a buyer’s registered card. Where a Buyer(s) fails to process instalment payment on or before the due date, and where automatically attempted payment for such Buyer (s) fails, the following shall take place:

    1. In the event that ordered Item(s) is yet to be delivered, the provisions of paragraph 8 above shall become applicable.

    2. In the event that ordered Item(s) has been delivered, the following late fee charges shall become applicable:

      1. For weekly installments, 3% of the amount due shall be charged on a weekly basis until payment is made by the Buyer; while

      2. For monthly installments, 10% of the amount due shall be charged on a monthly basis until payment is made by the Buyer.

      3. There shall be no limit to late fee payable in the event that ordered Gadget(s) has been delivered.

  10. Buyer(s) shall be eligible to have ordered Items(s) delivered 15 days after the midpoint of chosen installment plan, provided that 50% of the price of the ordered Item(s) has been paid. PLEASE NOTE THAT A BUYER WILL BE ELIGIBLE TO HAVE ITEM(S) DELIVERED ONLY IF THE BUYER HAS PAID THE INSTALLMENT SUM CONSISTENTLY AS AND WHEN DUE. FAILURE TO SATISFY THIS REQUIREMENT SHALL OPERATE TO POSTPONE DELIVERY OF ORDERED ITEM(S) TO WHEN THE INSTALLMENT IS FULLY COMPLETED. Notwithstanding the delivery of ordered Item(s) to the Buyer (s); the following terms shall be applicable at all times during the pendency of an active installment plan:

    1. All Item(s) purchased on Installment Plan remain property of CDcare until Buyer(s) complete all instalment payment. For the avoidance of all doubt, CDcare’s ownership of all ordered Item(s) subsists even after Item(s) has been delivered to the Buyer (s) and CDcare’s ownership in the delivered Item(s) shall continue to subsist until Buyer (s) fully complete the installment payment.

    2. For all intent and purposes, Buyer (s) are deemed as lessees of the delivered item(s) with a right to purchase same and the instalment sum paid is deemed as rent payable for the use of such Item(s) until the full purchase price is fully paid up.

    3. A Buyer who fails to complete the installment payment as and when due shall lose the right to purchase the affected Item(s) and shall become immediately obligated to return the Item(s) if already delivered to him/her.

    4. Upon becoming obligated to return the Item(s), CDcare reserves the right to retrieve such Item(s) from the possession of such Buyer (s) without first seeking or obtaining the consent of the Buyer (s).

    5. CDcare shall be entitled to exercise the right of retrieval without making any recourse to court, or obtaining any court order, police order or any other administrative order whatsoever.

    6. All the costs that is incurred by/in retrieving items from the buyer shall be paid in full by buyer before the item(s) are returned or refunds are made.

    7. CDcare may demand return of delivered Item(s) -

      1. ​virtually by sending emails, sms or placing phone-calls to the Buyer (s), or

      2. physically by sending CDcare Recovery Agents to visit the Buyer (s) designated address or location to demand a return of the delivered Item(s).

      3. Upon demand by CDcare, defaulting Buyer (s) hereby agrees to promptly return all affected Item(s) to CDcare’s office designated for such returns within 48 hours of demand by email or phone call, or the Buyer (s) shall immediately deliver the affected Item(s) to CDcare Recovery Agents upon the Recovery Agents visit the Buyer’s designated address for such recovery.

      4. A Buyer who promptly returns or delivers the affected Item(s) shall be entitled to refund in line with para 14e (i) to (iv) below.

      5. A Buyer who fails to promptly return or deliver up the affected Gadget(s) as stated above shall be sued for criminal conversion and shall be liable to pay the cost of litigation as well as attorney’s fee for himself/herself as well as CDcare. This is in addition to all other rights which CDcare may exercise against the defaulting Buyer.

  11. Delivery of Item(s) purchased on Installment Plan is subject to availability of the ordered Item(s) as at the midpoint of the chosen installment plan when 50% of the purchase price must have been paid (e.g third month of a six-month installment plan) and not the availability on the date Item(s) were ordered. In the event that the ordered Item(s) is no longer available as at the midpoint of the chosen installment plan when payment of at least 50% of the sales price of the ordered Item(s), Buyer (s) shall be requested to choose other Item(s) within the range or category of the Item(s) ordered from a list of Item(s) in the marketplace on the CDCare App; alternatively, the Buyer (s) may be requested to wait a certain period during which period CDcare shall make reasonable effort to procure the ordered Item(s) to be delivered to the Buyer (s) in line with CDcare delivery policies.

    1. The price payable on Item(s) purchased on Installment Plan shall be the current price of the Item(s) as listed on the CDcare App as at the midpoint of the installment plan duration when delivery is being processed and not as at the date the order was made by the Buyer (s). CDcare reserves the right to review the purchase price of any ordered Item(s) either upward or downward, provided that a downward review of the purchase price shall be possible only before the Buyer (s) reaches the midpoint of his/her chosen installment plan and not thereafter. In the event of an upward review of the purchase price, the Buyer (s) shall be notified to accept the difference in the price of the ordered Item(s) before the ordered Item(s) will be processed for delivery to the Buyer. Please note that the upward or downward review of a purchase price is completely at CDcare’s discretion, and CDcare shall only be obligated to deliver ordered Item(s) whose purchase price has been reviewed ONLY IF the Buyer(s) agrees to pay the difference in the reviewed price of the ordered Items(s) as stated in this paragraph and fulfills all other terms and conditions of CDcare.

  12. Buyer may request to have the Instalment Plan terminated at any time provided that the ordered Item(s) is not yet delivered. REFUND OF ANY PAYMENTS MADE PRIOR TO THE TERMINATION DATE IS REFUNDABLE LESS AN AMOUNT EQUAL TO 10% OF THE TOTAL INSTALMENT SUM ALREADY PAID INCLUDING THE INITIAL DEPOSIT IF ANY. NO REFUND SHALL BE MADE EARLIER THAN 30 DAYS FROM THE DATE OF TERMINATION OF INSTALMENT PLAN.

  13. a)BUYER(S) MUST ENSURE THAT EACH PAYMENT SHALL BE MADE ON OR BEFORE ITS DUE DATE IN ORDER TO SUCCESSFULLY COMPLETE THE INSTALLMENT PLAN AND RECEIVE THE ORDERED ITEM(S) ACCORDING TO THE TERMS AND CONDITION HEREIN CONTAINED. ​b) FAILURE TO MAKE ANY PAYMENT AS AND WHEN DUE SHALL AMOUNT TO AUTOMATICALLY TERMINATING THE INSTALLMENT PLAN WITHOUT ANY RECOURSE TO THE BUYER WHOSE INSTALMENT PLAN WAS TERMINATED. c) BUYER(S) FURTHER UNDERSTANDS THAT REFUND OF ANY INSTALMENT PAYMENTS MADE PRIOR TO THE TERMINATION DATE IS REFUNDABLE LESS AN AMOUNT EQUAL TO 10% OF THE TOTAL INSTALMENT SUM ALREADY PAID INCLUDING THE INITIAL DEPOSIT. d) BUYER FURTHER UNDERSTANDS THAT FAILURE TO MAKE ANY PAYMENT BY ITS DUE DATE WILL RESULT IN HIS OR HER ELIGIBILITY TO SUBSCRIBE TO AN INSTALLMENT PLAN BEING QUERIED AND SUCH BUYER(S) SHALL NO LONGER BE ABLE TO SUBSCRIBE TO ANY OTHER INSTALMENT PLAN UNLESS THE BUYER GIVES SUFFICIENT REASON TO CDCARE AND IS SUBSEQUENTLY CLEARED BY A CDCare AGENT AFTER CONSENTING TO BEING CHARGED ACCORDING TO THE TERMS AND CONDITIONS THAT MAY BE COMMUNICATED TO THE BUYER(S) AT THE RELEVANT TIME. TO ALL INTENT AND PURPOSES, THE ORDERED ITEM(S) SHALL NOT BE DELIVERED TO A DEFAULTING BUYER(S) UNTIL THE INSTALLMENT PAYMENT IS FULLY PAID. e) IN THE EVENT OF REFUND, NO REFUND SHALL BE PAID EARLIER THAN 30 DAYS FROM THE DATE OF TERMINATION OF INSTALLMENT PAYMENT WHETHER TERMINATION WAS DUE TO THE BUYER’S REQUEST OR BUYER’S FAILURE TO COMPLY WITH THE TERM OF INSTALMENT PLAN PRIOR TO DELIVERY OF ITEM(S). f)FAILURE TO COMPLY WITH THE TERMS OF INSTALLMENT PAYMENT PLAN AFTER ORDERED ITEM(S) HAS BEEN DELIVERED TO BUYER(S) SHALL BE TREATED AS FOLLOWS:

  14. THE ITEM(S) DELIVERED SHALL BE RETRIEVED FROM THE BUYER IN LINE WITH THE TERMS CONTAINED IN PARA 10 SUB-PARA (1) TO (9).

    1. THE ITEM(S) SHALL BE SOLD OFF AS USED ITEM(S). CDCARE IS NOT UNDER ANY OBLIGATION TO EXERCISE ANY DUTY OF CARE WHATSOEVER IN SELLING THE USED ITEM(S).

    2. THE UNPAID BALANCE OF THE INSTALLMENT SUM SHALL BE DEDUCTED FROM THE AMOUNT THE ITEM(S) IS SOLD

    3. ALL COSTS INCURRED BY/IN RETRIEVING THE ITEM(S) FROM THE BUYER AND IN SELLING THE ITEM(S), SHALL EQUALLY BE DEDUCTED FROM THE BALANCE OF THE AMOUNT THE ITEM(S) IS SOLD

    4. WHATEVER IS LEFT AS THE BALANCE OF THE AMOUNT THE ITEM(S) IS SOLD AFTER THE ABOVE DEDUCTIONS HAS BEEN MADE SHALL BE REFUNDED TO THE BUYER, PROVIDED THAT NO REFUND SHALL BE MADE WHERE NOTHING IS LEFT OF THE SALES PRICE OF THE USED ITEM(S) AFTER ALL DEDUCTIONS.

    5. IN THE EVENT OF REFUND, NO REFUND SHALL BE PAID EARLIER THAN 30 DAYS FROM THE DATE THE RETRIEVED ITEM(S) IS SOLD OFF AS USED ITEM(S).

    6. CDCARE MAY NOT DELIVER AN ITEM UNTIL 100% PAYMENT IF A BUYER HAS DEFAULTED IN PREVIOUS PAYMENTS.

    7. CDCARE MAY ALSO CHOOSE TO NOT DELIVER AN ITEM UNTIL 100% PAYMENT ON SUSPICION OF FRAUD AND MAY NOT COMMUNICATE THE REASON TO THE CUSTOMER.

  15. CDcare is not obligated to join in any promo sales or season nor is it obligated to run discounted sales, clearance sales, discount, bonus, bonanza or promo sales for any Item(s) listed on the CDcare app; however, CDcare may exercise its discretion to join or run promotions as it deems fit.

  16. Subscription to any purchase plan on CDcare app shall mean that the Buyer (s) (subscriber) has accepted the terms and conditions of CDCare, by which acceptance the Buyer (s) also represents and warrants that he/she is eligible to subscribe to the Installment Plan. Subscription to the Instalment Plan services shall be void where Buyer (s) (subscriber) is found to be ineligible.

  17. Money Box: Moneybox is not a wallet and CDcare is not a bank for saving money, but a temporary place to put money before paying for your instalment. kindy note that all payments to the money box are automatically treated as for instalment payments and refunds shall attract a 10% withdrawal fee and refunds from money box will only be made after a user has verified his/her identity.

  18. Eligibility Requirements

    1. To be eligible to subscribe to the Installment Plan, a buyer must:

    2. Be a registered user of the CDCare App.

    3. Be 18 years old and above

    4. Be a citizen of Nigeria and a resident in Nigeria

    5. Be capable of entering into a legally binding contract

    6. Have a valid and verifiable email address and mobile telephone number

    7. Have duly registered and can electronically verify any of:

      1. National Identification Card that clearly shows the National Identification Number (NIN) of the holder

      2. Bank Verification Number(BVN).

    8. Provide a valid delivery address in Nigeria; and

    9. Be an authorized holder of an eligible Naira debit/MasterCard or any other card valid for payment and must have the authority to use the payment method provided.

    10. Must be willing to have the payment card details added to his/her account for payment automation.

    11. Must live or work at an electronically verifiable address​​

  19. INSURANCE TERMS:​ The insurance is optional on CDcare and it comes at 10% of the cost of the item. ​

    1.  Insurance does not cover theft. The item must be physically provided and identifiable with the serial number or equivalent for claims to be made.

    2. Insurance only covers repair or replacement of damage that the warranty of manufacturer does not cover.

    3. Customers have to pay 20% of the cost of repair or replacement, as the case may be. 

    4. For a claim to be made on insurance, the customer must have to complete the payment of the item, then pay 20% of the estimated cost of repair or replacement, as the case may be. 

    5. The customer claiming insurance bears the cost of logistics.

  20. DISCLAIMER

  21. CDcare is not into manufacturing of any product whatsoever; hence no Item(s) listed on CDcare App is/was manufactured, produced or assembled by CDcare. CDcare shall not be liable to any Buyer(s) for error, defects, or any damages suffered by such Buyer (s) as a result of coming in contact with or using any such item(s) purchased from CDcare App. All item(s) listed on the CDcare app contains the description of the respective manufacturers who shall be liable for any errors, defects, or damages suffered by such users in line with the respective manufacturer’s terms and conditions for such liability.
